The High Court’s decision in Garnock v Black – handed down on 1 August 2007 – has significantly affected conveyancing practice throughout Australia.

The central issue in the case was the effect of registration of a judgement creditor’s writ on a contract for sale where the purchaser had not lodged a caveat.

The High Court held that the creditor’s rights under the writ trumped the purchaser’s rights under the contract.
